Terms and conditions

Scope and object of the General Conditions

These General Conditions are intended, together with the order form and the other elements referred to therein, to regulate the terms and conditions governing the provision of the Online Shop Service, YNTENZO, by NORTEMPRESA, LDA., with registered office at Rua Parque Bouça das Mouras, n.º 56, Nogueira, 4705-216, Braga, under the single registration and legal person identification number 509 312 519.

The YNTENZO Website, yntenzo.com (hereinafter referred to as the “Website”) is an e-commerce Website that offers for sale perfumes and other cosmetic products and accessories to consumers browsing the Website.

The order of products must be made by Users aged 18 (eighteen) years or older (individuals under the age of 18 must have authorization from their representatives). The elements and information transmitted by the User shall enjoy full legal effect, with the User acknowledging the electronic purchases, and the User may not claim the lack of signature for breach of the obligations assumed.

Product and Content Information

YNTENZO will make every effort to ensure that the information presented does not contain typographical errors, and will be promptly corrected whenever they occur.
If you purchase a product that has different characteristics to those presented online, you have the right to terminate the purchase contract under the applicable legal terms (right of free withdrawal).

YNTENZO will do everything possible to send all the products ordered, but it is possible that, in certain cases and due to causes difficult to control by YNTENZO, such as human errors or incidents in computer systems, it will not be possible to provide some of the products ordered by the User. If a product is not available after you have placed your order, you will be notified by post.

Responsibilities

All products and services sold in the YNTENZO Online Store are in accordance with Portuguese Law.

The Store has adequate levels of security, however YNTENZO shall not be liable for any damages suffered by the User and/or third parties due to delays, interruptions, errors and suspensions of communications that originate from factors beyond its control, in particular, any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software or any computer viruses or arising from the download (“download”) through the service of files infected or containing viruses or other properties that may affect the User’s equipment. If for any reason of error in accessing the YNTENZO Online Store website it is impossible to provide the service, YNTENZO will not be responsible for any losses.

Data and information queries made within the scope of this Service are presumed to have been made by the User, and YNTENZO declines any liability arising from the abusive or fraudulent use of the information obtained. YNTENZO shall not be liable for any loss or damage caused by the use of
abuse of the Service which is not directly attributable to you by way of intent or gross negligence.

YNTENZO shall not be liable for any loss or damage arising from the non-performance or defective performance of the Service when this is not directly or indirectly attributable to it by way of intent or gross negligence, and shall not be liable in particular for (i) errors, omissions or other inaccuracies concerning the information made available through the Service; (ii) damages caused by the fault of the User or third parties, including intellectual property infringements, (iii) for non-compliance or defective compliance resulting from the enforcement of judicial decisions or decisions of administrative authorities, or (iv) for non-performance or defective performance resulting from the occurrence of force majeure situations, that is, situations of an extraordinary or unforeseeable nature, external to YNTENZO and which cannot be controlled by it, such as fires, power cuts, explosions, wars, riots, civil insurrections, government decisions, strikes, earthquakes, floods or other natural cataclysms or other situations not controllable by YNTENZO that prevent or impair the fulfillment of the obligations assumed.

YNTENZO does not guarantee that:
(i) the Service is provided uninterruptedly, is secure, error-free or operates infinitely; (ii) the quality of any product, service, information or any other material purchased or obtained through the Service fulfills any expectations of the User in relation thereto; iii) any material obtained in any way through the use of the Service is used at the User’s own risk, and the User is solely responsible for any damage caused to its computer system and equipment or for any loss of data resulting from such operation; and (iv) no advice or information, whether oral or written, obtained by the User from or through the Service shall create any warranty not expressly made in these General Conditions.

ii) You agree that YNTENZO shall in no way be liable for any damages, including but not limited to damages for loss of profits, data, content, or any other losses (even if you have been previously advised by us of the possibility of such damages), resulting therefrom: i) the use or inability to use the Service; (ii) the difficulty of obtaining any substitute goods/services; and (iii) unauthorized access or modification of personal databases.

Consumer Obligations

The user undertakes to: i) Provide correct personal data and addresses; (ii) not to use false identities; and iii) Respect the order limits imposed.

If any of the data is incorrect, i.e. insufficient, and for this reason there is a delay or impossibility in processing the order, or possible non-delivery, the responsibility lies with the User, and YNTENZO declines any responsibility. In the event that the consumer violates any of these obligations, YNTENZO reserves the right to delete future purchases, block access to the store, cancel the provision of any other services made available simultaneously by YNTENZO to the same User; and also not allow future access by the User to any or all services made available by YNTENZO.

It is expressly forbidden to use the products and services purchased for commercial purposes, namely for the purpose of reselling goods.

Privacy and Personal Data Protection

YNTENZO guarantees the confidentiality of all data provided by Users.

The personal data identified in the order form as being mandatory to provide are indispensable for the provision of the Service by YNTENZO. A
omission or inaccuracy of the data provided by the User is the sole and entire responsibility of the User and may result in YNTENZO refusing to provide the Service.

NORTEMPRESA, Lda., legal person with NIPC 509312519 and with registered office at Rua Parque das Bouças, n.o 56 – Nogueira, Fraião e Lamaçães, 4715 Braga is the entity responsible for the collection and processing of personal data, for the purposes referred to in this privacy policy.

Indeed, NORTEMPRESA, Lda. undertakes to process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 20 December 2016 on the protection of individuals with regard to the protection of personal data (Regulation (EU) 2016/679)
Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of personal data.

NORTEMPRESA, Lda. will collect and process the personal data of users of this website to process and manage requests for contact and the provision of legal services, the terms of which will be governed by the agreed contractual clauses and applicable rules.

NORTEMPRESA, Lda. will process the following categories of users’ personal data: identification and contact data, billing data and/or information in the context of responding to any questions, requests or complaints from the user.

The personal data of customers/users will be stored for a maximum of 3 years after the end of their use.

In accordance with the legislation in force, NORTEMPRESA, Lda. provides an adequate level of protection for the personal data of its customers/users, in particular by implementing technical and organizational measures necessary to protect their personal data against accidental destruction, loss or modification, as well as against access and other unauthorized processes. Measures taken include encrypting data and securing the applications that process it.

NORTEMPRESA, Lda. guarantees its customers/users, at any time, the right of access, rectification, updating, limitation and erasure of their personal data (except for data that are indispensable for the provision of legal services or for the fulfillment of legal obligations to which the controller is subject), the right to object to their use for purposes other than the provision of the contracted services as well as the right to data portability.

You also have the right to obtain a copy of your data that is processed and the right to be informed, in the event of automated decision-making, of the logic behind such a system as well as the significance and consequences of its processing for you.

Without prejudice to the provisions of the General Data Protection Regulation, you may exercise any of these rights, directly or by written request, addressed to NORTEMPRESA, Lda. through the contacts provided for this purpose in this document.

NORTEMPRESA, Lda., within the scope of its activity, may use the services of subcontractors, companies in charge of processing customer/user data for accounting and computerization/information management purposes.

These companies are linked to NORTEMPRESA, Lda. by written contract may only process the personal data of customers/users for the purposes specifically set out above and are absolutely prevented from processing personal data, directly or indirectly, for any other purpose, for their own benefit or that of a third party.

In compliance with legal obligations, personal data may also be transmitted to judicial and administrative authorities.

Return (Right of withdrawal / Manufacturing defect)

Any return/exchange of items must comply with the following condition: Return of the items in good condition (in saleable condition), with original packaging inviolate, without having been tried on and accompanied by the respective invoice. If the packaging is damaged and the items show obvious marks of use, YNTENZO cannot accept the exchange or the refund. You have a period of 30 days after receipt of the order to proceed with the exchange or return. If you wish to exchange or return any of your items, please go directly to any YNTENZO store accompanied by the purchase invoice. If you prefer, please contact our Customer Support by email info@yntenzo.com, communicating the intention to exchange or return, indicating the order number or invoice number, products to be returned and reason. After this contact you will be given the indications to proceed with the exchange or return. In
if you do not send the items without prior contact, they will not be received. After contacting our Customer Support and being given the

If you choose to exchange the product we inform you that: The shipping costs to the address of NORTEMPRESA, LDA are borne by the customer, except for customers injured by transportation or technical problem of the product. In these cases, the shipping costs will be borne by YNTENZO. The exchange will only be made after checking the condition of the product and compliance with the conditions described above. If you choose to return the amount, we inform you that: Shipping costs to our address are borne by the customer, except for customers injured by transportation or technical problem of the product. In these cases, the shipping costs will be borne by YNTENZO. Refunds will be made for the total value of the order (products plus shipping costs), unless the reason for the return is not the responsibility of our service – in these cases, shipping costs will be deducted from the refund amount. The return will only be made after checking the condition of the product and compliance with the conditions described above.

In the event that the shipping packaging is damaged, you should check its contents at the time of delivery and immediately complain to the
carrier, then contact our Customer Support. You should also contact our Customer Support if you have received a package in good condition but the items are still damaged.

The method of refunding the amount to be returned depends on the payment method used in the respective order. In the case of credit card and PayPal payments, these are credited to the respective accounts. In all other cases, when NIB information is provided, the refund is made to the bank account indicated. Refunds are made within 30 days of receipt of the wish to withdraw and receipt of the return of the goods.

Intellectual Property

The Store is a registered site and the Service provided by the site itself is the responsibility of NORTEMPRESA, LDA.

The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.

The User acknowledges that any content appearing in the advertising, highlighting, promotion or mention of any sponsor or advertiser is protected by copyright and related rights laws, industrial property laws and other property protection laws, so any use of such content may only occur under the express authorization of the respective owners.

The User undertakes to fully respect the rights referred to in the previous paragraph, namely by refraining from performing any acts that may violate the law or those rights, such as the reproduction, commercialization, transmission or making available to the public of such content or any other unauthorized acts that have as their object the same content.

Safety Conditions of Service

The User undertakes to comply with all applicable legal provisions, in particular, not to practice or encourage the practice of unlawful acts or offensive to good customs, such as the indiscriminate sending of unsolicited communications (spamming) in violation of the provisions of the legislation applicable to the processing of personal data and advertising communications through automatic calling devices and must also observe the rules for the use of the Service, under penalty of YNTENZO suspending or disabling the Service under the terms provided for in the “Communications” section.

The User expressly acknowledges and accepts that the IP Network is a public electronic communications network susceptible to use by several users, and as such, subject to computer overloads, so YNTENZO does not guarantee the provision of the Service without interruptions, loss of information or delays.

YNTENZO also does not guarantee the provision of the Service in situations of unpredictable overload of the systems on which it is based or force majeure (situations of an extraordinary or unpredictable nature, external to YNTENZO and which cannot be controlled by it).

In the event of interruption of the provision of the Service for reasons of unforeseeable overload of the systems on which it is based, YNTENZO undertakes to regularize its operation as soon as possible.

Suspension and deactivation of the Shop Service

Regardless of any prior or subsequent notice, YNTENZO may, at any time, and in its sole discretion, discontinue making the Service and or part of the Service available to any or all Users.

YNTENZO also reserves the right to immediately suspend or terminate access to the Service in the following cases: i) When the User does not comply with the conditions of use referred to in the section “Consumer Obligations” and others referred to in the General Conditions; When YNTENZO ceases access to the Store / Website, upon prior notice of 15 days before the date of termination.

The suspension or termination of the Service by YNTENZO, pursuant to the preceding paragraphs, does not entitle the User or third parties to any indemnity or other compensation, and YNTENZO may not be held liable or otherwise burdened for any consequence resulting from the suspension, cancellation, termination of the Service.

In the situations described above, YNTENZO will inform the User in advance so that he/she can, if he/she wishes, safeguard the content of his/her order viewing area within 3 (three) working days of sending the e-mail or making the information available on the main page of the Service.

Communications

Whenever YNTENZO deems it necessary or convenient to optimize the browsing experience and/or improve connectivity conditions, it may remotely reformulate the network settings.

Without prejudice to the provisions of the following paragraphs, and in view of the innovative nature of the Service and the technological developments to which it may be subject, YNTENZO may change the technical configurations of the Service whenever it proves convenient to adapt it to any technological developments.

However, YNTENZO does not guarantee the User any upgrades or improvements to the Service.

Some upgrades or new features of the Service may be available only against payment by the User and/or subscription by the User to Specific Conditions of Use.

Complaints

The User may submit any contractual disputes to the arbitration and mediation mechanisms that are or will be legally constituted, as well as complain to YNTENZO about acts and omissions that violate the legal provisions applicable to the acquisition of goods.

The complaint must be submitted within a maximum period of 30 (thirty) days, counted from the knowledge of the facts by the User, being registered in the information systems of YNTENZO, which must decide the complaint and notify the interested party within a maximum period of 30 (thirty) days from the date of receipt.

Applicable Law

The Contract is governed by Portuguese law. To judge all issues arising from the Terms of Use, the jurisdiction of the District of Braga is established, with express waiver of any other.
